CONTRACT TERMS and CONDITIONS

GENERAL


1.0. The contract will initially be for troubleshooting and fault diagnosis of: Machinery / Plant / Production-Line / etc

1.1. A repair is regarded as an "extra" to the contract.

1.2. Repairs will be carried out only when the customer provides the required parts.

1.3 If the repair requires the replacement of parts involving heavy engineering or the moving of large motors or equipment, the heavy work will be carried out by the customer's own employees.

1.4. At the time of the diagnosis and repair, the machinery / plant / etc. will have all the appropriate services connected e.g.electricity, water, hydraulics, compressed air etc.

1.5. Any delays caused by the customer or their suppliers failing to supply parts and / or services at the appropriate times will be charged for at the appropriate rates.

1.6. Should the contract necessitate overnight accommodation, this will be arranged and paid for by the customer.

1.7. The customer will discharge all travelling expenses and for contracts not on mainland Britain the customer will also arrange and pay for all flights / sailings and transfers.

1.8. For contracts in countries where visas are required the customer will make all necessary applications/arrangements and will ensure my personal receipt of visas before commencement..

THE FEES


Simple faults will incur little or no charge depending on the time spent diagnosing, emailing, faxing etc.

More serious faults will incur higher charges. The nature of troubleshooting is unpredictability. A fault can be detected in either minutes, hours, or days. If I believe that the fee will be in excess of £200.00 sterling I will estimate how long it is going to take me to diagnose the fault and email the estimate to the customer before I investigate the fault.

Fees & Terms specific to: Call-outs to Mainland Britain etc

2.0. A "day" being: More than four hours and less than twelve hours "on-site".

2.1. The "on-site" fee is £300.00 per day.

2.2. Travelling is charged at £150.00 per day or £20.00 per hour, (whichever is the least).

2.3. Travelling is not charged for if the contract involves more than four days "on-site".

2.4. Fifty percent of the "estimated" fee to be paid prior to the commencement of the contract

2.5. All invoices to be paid within seven days of receipt. Overdue payments will attract "interest" calculated daily at 5% above the prevailing base rate of supplier's own bank, plus any additional third-party costs and charges whatsoever in this connection, howsoever incurred .

2.6. All reasonable expenses incurred by myself during the execution of the contract shall be reimbursed by the customer immediately upon completion of the contract.

2.0. A "day" being: More than four hours and less than twelve hours "on-site".

2.1. The "on-site" fee is £400.00 per day.

2.2. Travelling is charged at £150.00 per day or £20.00 per hour.

2.3. Travelling time is not charged where the contract involves more than five days "on-site".

2.4. "Access" to carry out contracted work is assumed at all times during the contract. Should Week-Ends, Public Holidays, etc., interfere with this understanding then these periods will be charged at £150.00 per day.

2.5. Fifty percent of the "estimated" fee to be paid prior to the commencement of the contract

2.6. All invoices to be paid within seven days of receipt. Overdue payments will attract "interest" calculated daily at 5% above the prevailing base rate of supplier's own bank, plus any additional third-party costs and charges whatsoever in this connection, howsoever incurred .

2.0. All payments to be made in Sterling or American Dollars.

2.1. The "on-site" fee is £500.00 per day.

2.2. Travelling time is charged at £150.00 per day.

2.3. Travelling time is not charged where the contract involves more than ten days "on-site".

2.4. "Access" to carry out contracted work is assumed at all times during the contract. Should Week-Ends, Public Holidays, etc., interfere with this understanding then these periods will be charged at £150.00 per day.

2.5. Fifty percent of the "estimated" fee to be paid prior to the commencement of the contract

REQUIREMENTS


3.1. Schematics, drawings, p.l.c. settings and all relevant information should be available to me during the contract and before if practicable.

3.2. Preference for receipt of items at 3.1., above, is via email attachment, in WebPage format or .pdf files, Only.

3.3. If the method at 3.2. above is not practicable, then Fax transmission becomes the preferred 2nd Option. If this requires "reduction" of the "original" paperwork, then clarity is likely to be affected and full-size copies may be required in addition, by "Postal" or Courier Service.

3.4. Originals, and copies, of schematics, drawings, etc., will be returned to the customer if requested, but please note that it is preferable to maintain copies on our files for convenient reference to your possible future needs.
